My name is Chad Gist and I have been married for 13 years, the little girls name is Hailey, she is my biological daughter. She was
the result of a 2 year affair I had with her mother whom is also married. I am not proud of the fact that I had an affair and I will be
the first to admit that it was wrong, but I wouldn't give that beautiful little girl back for nothing in the world. When she was born
her mother allowed me to have a private DNA test done and just as we thought she was my daughter. Hailey's mother allowed me
and my family to begin a relationship with her. She would bring her to my house almost every other weekend, I would also meet
her at the park or other places about 2 or 3 times during the week, and I even would keep her for 4 or five days at a time. That went
on for about 8 months. She told me that she would never keep my daughter away from me, and that Hailey deserves to know her
father.
Well all that changed in late May, her husband told her that if she has anything to do with me or allows me to see Hailey that he was
going to leave her. So she choose to keep her away from me, she thought that her marriage was more important than her
daughter knowing her father. So I had no other choice but to hire a lawyer and file whats called a Paternity Action Law suit so that
I could go to court and have a judge tell them to let Hailey see her father. Up until this point in my life I truly believed in the court
system and I always felt the constitution was there to protect me and my family and would stand up for my rights, BOY WAS I
WRONG. See this is where things went really wrong.
In court I was informed that there is a law in Florida that is over 200 yrs old( some research I have found states that it is over 500
yrs old) That states that if a man and woman are married when a child is born that the husband is presumed the father,and that a
paternity suit cannot be brought against them. But listen to this, if Hailey's mother and her husband decide down the road to get a
divorce, then the husband has the right to contest the paternity of Hailey at that time so he does not have to pay child support. At
that point the State of Florida will then come after me to support Hailey, even though I have offered countless times to pay child
support now and just let me be there as her father. This is the unjustly law that is preventing me and my family from seeing my
daughter. Oh yea you would think that because I had a DNA test done that the Judge would have no choice but to allow me to see
my daughter, WRONG AGAIN. Yes the judge has every right to rule that way but he is now ruling that I cannot use my test. Would
someone please tell me how any court, judge, law maker can have the right to tell someone that they cannot know who there
parents are, even more she has a brother and a sister, grandmother and grandfather, a whole other family that she deserves to
know and who deserves the right to know her.
If there was only one message that I would want to get through to Hailey's mother and her husband is that HAILEY IS
NOT TO BLAME , SO WHY PUNISH HER, SHE SHOULD BE THE ONLY
ONE YOU ARE CONCERNED WITH, NOT YOUR OWN FEELINGS. YOU
BOTH KNOW THAT SHE DESERVES THE RIGHT TO KNOW HER
FATHER, WHY STEAL YEARS OF MEMORIES AWAY FROM HER THAT
SHE CANNOT GET BACK JUST BECAUSE YOU ARE MAD AT ME.
I have made a choice in my life to make a difference and I am dedicated to change that law, not only for my self but for all fathers
who want to be a man and take care of there children. This law can affect and has affected many families across Florida. There
have been cases where a man and woman have lived together and she got pregnant but before the child was born they broke up
and she married someone else and the real father has no rights to that child, you tell me how that is fair, how can there be law that
supports that. Times have changed a marriage is not like it used to be, when this law was written you were married forever, now
you can be married and divorced in the same week.
